COSMICK MEDIA PRIVACY POLICY

Cosmick Media, Inc. (“Cosmick,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our websites, submit a form, communicate with us, receive our marketing, use our software or online platforms, or engage with our marketing, advertising, consulting, website, development, or related services (collectively, the “Services”).

This Privacy Policy applies to Cosmick-operated services and programs, including the Cosmick Growth Accelerator Program (“CGAP”), Dripley, MediaHub, the Cosmick Media Messaging Program, and other Cosmick websites, landing pages, portals, applications, and tools that link to this Policy.

IMPORTANT MOBILE INFORMATION NOTICE

The Cosmick Media Messaging Program is a first-party program operated solely by Cosmick Media, Inc. Cosmick does not use this program for affiliate marketing, third-party lead generation, purchased leads, or marketing a client’s, partner’s, affiliate’s, or other third party’s products or services.

Cosmick does not sell, rent, buy, transfer, share, or otherwise disclose mobile telephone numbers, text-message originator opt-in data, or mobile messaging consent to any third party or affiliate for marketing or promotional purposes. This includes marketing performed by Cosmick on behalf of a client.

Mobile information may be provided only to communications service providers and telecommunications carriers that process it on Cosmick’s behalf and solely to deliver, support, secure, and administer Cosmick’s messages. This Mobile Information Notice and Section 9 control over any other provision that could otherwise be interpreted differently.

This Privacy Policy does not replace a separate agreement between Cosmick and a client, and it does not necessarily govern personal information that Cosmick processes solely on a client’s behalf. Section 6 explains the distinction between information we control and information we process for clients.

1. Personal Information We Collect

The information we collect depends on how you interact with us and may include the following categories:

1.1 Contact and Identifying Information

Name, business name, mailing or business address, email address, telephone or mobile number, job title, professional role, social media profile, account identifier, and other contact information.

1.2 Account, Client, and Commercial Information

Account credentials; client intake and onboarding information; proposals, contracts, preferences, service selections, purchase and transaction history; billing records; customer-support history; and information concerning your relationship with Cosmick.

1.3 Payment Information

Billing address, payment method information, transaction details, and related financial records. Payment information may be collected and processed by our payment processors.

We do not use payment information for purposes unrelated to billing, fraud prevention, accounting, or providing requested Services.

1.4 Communications and Messaging Information

Emails, form submissions, chat content, text or multimedia message content, call recordings where permitted by law, voicemail, support communications, survey responses, meeting notes, and related communications metadata such as sender and recipient information, telephone numbers, timestamps, delivery status, opt-in records, HELP requests, and opt-out records.

1.5 Content and Service Data

Files, photographs, videos, descriptions, advertising materials, brand assets, reports, CRM records, contact activity, tags, campaign flows, lead-source information, campaign performance information, website information, and other content submitted to or generated through MediaHub, Dripley, CGAP, or another Service.

1.6 Device, Internet, and Network Activity

IP address, browser type, operating system, device type, device identifiers, general location derived from IP address, referring and exit pages, pages viewed, links clicked, form interactions, session activity, dates and times of access, error logs, and other information about how you interact with our websites, emails, advertisements, and Services.

1.7 Advertising and Analytics Information

Advertising identifiers, cookie identifiers, conversion events, campaign attribution, audience information, engagement information, and performance data from tools and platforms such as Google Analytics, Google Ads, Meta, Microsoft, YouTube, and similar analytics or advertising services.

1.8 Integration and Third-Party Platform Information

Information made available when you connect or authorize an integration with Google, Meta, Microsoft, YouTube, Zoho, Groundhogg, a call-tracking provider, a CRM, an advertising platform, or another third-party service.

The information received depends on your settings, permissions, and the applicable integration.

1.9 Inferences

We may derive business, marketing, service, or communication preferences and related insights from the information described above.

We do not use sensitive personal information to infer characteristics about an individual except as permitted by law.

1.10 Sensitive Personal Information

Depending on the Service, we or our service providers may process account credentials, payment information, message contents, or other information treated as sensitive under applicable law.

We ask that you not submit Social Security numbers, government identification numbers, medical information, precise geolocation, financial credentials, or other highly sensitive information through general website forms or text messages unless we specifically request it through an appropriate secure channel.

2. How We Collect Personal Information

We may collect personal information:

(a) directly from you when you submit a form, create an account, contact us, enroll in communications, sign an agreement, make a payment, upload content, or use the Services;

(b) automatically through cookies, pixels, tags, software development kits, local storage, server logs, and similar technologies;

(c) from clients that engage Cosmick to provide marketing, CRM, communications, advertising, or related services;

(d) from service providers, analytics companies, advertising platforms, social networks, call-tracking providers, telecommunications carriers, messaging providers, and integration partners;

(e) from publicly available sources, business directories, professional profiles, and information you make public; and

(f) from referrals, event partners, and other persons who represent that they are authorized to provide the information.

Information obtained from clients, referrals, business directories, public sources, advertising platforms, or other third parties is not treated as consent to receive text messages from Cosmick. Mobile messaging consent must be provided directly and affirmatively to Cosmick through a campaign-specific enrollment method.

3. How We Use Personal Information

We may use personal information to:

(a) provide, configure, operate, maintain, and improve the Services;

(b) respond to inquiries, schedule consultations, provide customer support, and manage our relationship with you;

(c) create and administer accounts, onboard clients, process payments, maintain business records, and fulfill contracts;

(d) operate CGAP, Dripley, MediaHub, the Cosmick Media Messaging Program, websites, forms, portals, reporting tools, and related features;

(e) develop, place, measure, attribute, optimize, and report on advertising and marketing campaigns;

(f) personalize content, recommendations, communications, and experiences;

(g) send service notices, administrative communications, alerts, reminders, newsletters, and marketing communications in accordance with your choices and applicable law;

(h) maintain records of consent, communication preferences, opt-outs, and suppression lists;

(i) detect, investigate, prevent, and address fraud, spam, abuse, security incidents, unlawful activity, or violations of our terms;

(j) debug, analyze, test, research, and improve the performance, reliability, usability, and security of the Services;

(k) comply with legal obligations, respond to lawful requests, establish or defend legal claims, enforce agreements, and protect rights, safety, property, and security; and

(l) create aggregated or deidentified information. Where required by law, we maintain deidentified information in deidentified form and do not attempt to reidentify it.

4. Legal Bases for Processing

Where a law requires us to identify a legal basis, we process personal information as necessary:

(a) to perform a contract with you or take steps at your request before entering into a contract;

(b) for our legitimate interests, such as operating and improving our business, communicating with business contacts, protecting the Services, preventing fraud, and measuring our marketing, where those interests are not overridden by your rights;

(c) to comply with legal obligations;

(d) with your consent, including where consent is required for cookies, marketing, or mobile messaging; or

(e) to protect vital interests or perform another processing activity permitted by applicable law.

You may withdraw consent at any time, but withdrawal does not affect processing that occurred before withdrawal or processing supported by another lawful basis.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this Policy.

The disclosures in this Section 5 do not apply to mobile telephone numbers, mobile opt-in information, or mobile messaging consent for marketing or promotional purposes. Mobile information is governed exclusively by the Important Mobile Information Notice above and Section 9.

5.1 Service Providers and Contractors

Hosting, cloud storage, website, CRM, payment, accounting, analytics, advertising, email, mobile messaging, telecommunications, call tracking, customer support, security, development, consulting, and other providers that perform services for us.

We require these parties to process information only for authorized purposes and subject to appropriate contractual or legal obligations.

5.2 Advertising, Analytics, and Platform Partners

Google, Meta, Microsoft, YouTube, and similar platforms may receive online identifiers, device information, browsing or interaction information, and conversion events for advertising delivery, analytics, campaign measurement, attribution, audience creation, or remarketing, subject to applicable law and your privacy choices.

5.3 Connected Services

When you direct us to connect an account or share information with another service, we may disclose information as necessary to complete that integration or request.

5.4 Professional Advisers

Attorneys, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary for their services.

5.5 Business Transactions

We may disclose information in connection with a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction.

Any recipient remains subject to applicable privacy, confidentiality, and mobile-consent restrictions. Mobile opt-in information and consent will not be transferred for another party’s independent marketing.

5.6 Legal and Safety Disclosures

We may disclose information when we reasonably believe disclosure is required by law, legal process, court order, or governmental request, or is necessary to investigate unlawful conduct, enforce agreements, protect rights or safety, prevent harm, or maintain the security and integrity of the Services.

5.7 With Your Direction or Consent

We may disclose information when you direct us to do so or provide legally valid consent.

6. Information We Process for Clients

Cosmick sometimes processes personal information on behalf of business clients, including customer, lead, CRM, advertising, website, call, form, and messaging information.

In those circumstances, the client generally determines why and how the information is processed, and Cosmick acts as its service provider, contractor, or processor.

If your information was collected by or on behalf of a Cosmick client—for example, when you submitted a form on a client’s website or communicated with a client through a Cosmick-supported tool—you should review that client’s privacy policy and direct privacy requests to that client. We will assist our clients with requests as required by law and our agreements.

Consent provided to a Cosmick client does not constitute consent to receive text messages marketing Cosmick’s products or services. Likewise, consent provided directly to Cosmick does not authorize text messages from a client or other third party.

Cosmick may separately act as a business or controller for information used to manage our client relationship, operate and secure our own Services, comply with law, prevent abuse, or market Cosmick’s own services. This Policy applies to those activities.

7. Cookies, Pixels, and Similar Technologies

We and our partners may use cookies, web beacons, pixels, tags, local storage, and similar technologies to:

(a) operate essential website and account functions;

(b) remember settings and preferences;

(c) understand traffic, performance, and interactions;

(d) detect fraud and maintain security;

(e) measure advertising and conversions; and

(f) personalize or deliver advertising and remarketing.

Some technologies are essential and cannot be disabled without affecting the Services. Where applicable law requires consent, we will request consent before activating non-essential technologies.

You may control cookies through your browser settings and through any cookie or privacy-choice controls that we make available on the website. Blocking cookies may not block every tracking technology and may cause some website features to function improperly.

8. Advertising, Sale, Sharing, and Privacy Signals

8.1 No Sale for Money

We do not sell personal information in exchange for money.

8.2 Advertising Disclosures

Our use of advertising cookies, pixels, and similar technologies may involve disclosing identifiers and internet activity to advertising or analytics partners.

Some privacy laws may define those disclosures as a “sale,” “sharing,” or use for targeted advertising even when no money is exchanged.

8.3 Opting Out

Where applicable, you may opt out of sale, sharing, or targeted advertising by:

(a) using any “Cookie Settings,” “Your Privacy Choices,” “Do Not Sell or Share My Personal Information,” or similar privacy control displayed on our website;

(b) enabling a legally recognized browser-based opt-out preference signal, such as Global Privacy Control (“GPC”); or

(c) contacting us using the information in Section 18.

Where required by applicable law and technically detectable, we process a recognized GPC signal as an opt-out request for the browser or device sending the signal.

Because cookie controls and browser signals are generally device- and browser-specific, you may need to exercise your choice on each browser and device that you use.

If an on-site privacy control is not displayed or does not function correctly, you may submit your request by emailing support@cosmickmedia.com or calling 866-208-5538.

8.4 Mobile Information Exclusion

Regardless of the advertising practices described above, mobile telephone numbers, text-message originator opt-in data, and mobile messaging consent are not sold, shared for cross-context behavioral advertising, or disclosed to any third party or affiliate for marketing or promotional purposes, including marketing conducted by Cosmick on behalf of a client.

Section 9 controls with respect to mobile information.

9. Mobile Messaging Privacy

This section applies when you communicate with or enroll in the Cosmick Media Messaging Program.

9.1 Information Collected

We may collect your mobile number, message content, messaging metadata, delivery status, enrollment source, date and time of consent, consent disclosures presented to you, HELP requests, opt-out requests, and other records needed to operate and document the messaging program.

9.2 Uses

We use mobile information to send messages you requested, respond to you, provide support, administer the messaging program, maintain consent and suppression records, troubleshoot delivery, prevent fraud or abuse, comply with law, and enforce our terms.

9.3 No Third-Party or Affiliate Marketing

Cosmick will not sell, rent, buy, or transfer your mobile number, mobile opt-in information, or mobile messaging consent.

Cosmick will not share or otherwise disclose that information to any third party or affiliate for marketing or promotional purposes, including marketing conducted by Cosmick on behalf of a client.

Text-message originator opt-in data and consent will not be shared with any third parties for marketing or promotional purposes. This exclusion applies notwithstanding anything else in this Privacy Policy that might otherwise be interpreted to permit broader data sharing.

9.4 Operational Disclosures

We may provide mobile information to communications service providers, messaging platform providers, telecommunications carriers, aggregators, hosting providers, support vendors, and security providers only when they process the information on Cosmick’s behalf and solely as necessary to:

(a) deliver and support messages;

(b) maintain security;

(c) prevent fraud or abuse;

(d) troubleshoot delivery;

(e) maintain consent and suppression records; or

(f) comply with law.

Those operational processors may not use the information for their own marketing or for marketing by any third party or affiliate.

9.5 Consent Is Not Transferable

Mobile messaging consent is specific to Cosmick and the message categories disclosed at enrollment.

We do not buy, sell, rent, or transfer mobile consent. We do not treat consent given to another sender as consent to receive messages from Cosmick.

9.6 Your Choices

You may opt out by replying STOP to any Cosmick message.

You may also use another reasonable method that clearly communicates your request, including contacting support@cosmickmedia.com or 866-208-5538 and identifying the mobile number to be removed.

Reply HELP for assistance.

Additional program terms, including message frequency and carrier-rate disclosures, appear in the Cosmick Media Terms of Service.

9.7 Consent and Suppression Records

We may retain proof of consent for as long as reasonably necessary to operate the program, respond to complaints, and meet legal or industry requirements.

After an opt-out, we may retain the mobile number and minimum related information on a suppression list to honor the request and prevent accidental re-enrollment without new consent.

10. Communication Choices

10.1 Email

You may unsubscribe from marketing emails by using the unsubscribe link in the message.

We may still send non-marketing messages that are necessary to respond to your request, manage an account, provide requested Services, protect the Services, or comply with law.

10.2 Mobile Messages

You may opt out as described in Section 9.6 and the Cosmick Media Terms of Service.

Opting out of text messages does not automatically unsubscribe you from email, and unsubscribing from email does not automatically opt you out of text messages.

10.3 Advertising

You may use the choices described in Section 8 and settings offered by advertising platforms. Opting out of targeted advertising does not necessarily eliminate all advertising.

11. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain accounts and business records, honor communication preferences, comply with legal, tax, accounting, and reporting obligations, resolve disputes, establish or defend claims, prevent fraud, and enforce agreements.

Retention periods depend on the type and sensitivity of the information, the relationship involved, contractual requirements, legal limitation periods, and applicable law.

We may retain:

(a) client, contract, billing, and transaction records for the applicable relationship and legally required accounting or tax periods;

(b) account and service data while an account is active and for a reasonable period afterward;

(c) security, system, analytics, and advertising records for periods appropriate to their operational purpose;

(d) consent evidence and communication records for the period necessary to demonstrate compliance; and

(e) opt-out and suppression information for as long as reasonably necessary to honor the request.

When information is no longer needed, we may delete, anonymize, or deidentify it, subject to backup, legal, security, and technical limitations.

12. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information.

Depending on the information and system, safeguards may include encryption in transit, access controls, authentication, logging, employee or contractor confidentiality obligations, backups, monitoring, and security review.

No system, transmission method, or storage method is completely secure. We cannot guarantee absolute security, and you should use appropriate care when sending information online or through text messaging.

13. Your Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

(a) confirm whether we process your personal information;

(b) access or obtain a copy of personal information;

(c) correct inaccurate personal information;

(d) delete personal information;

(e) obtain personal information in a portable format;

(f) opt out of sale, sharing, targeted advertising, or certain profiling;

(g) limit certain uses or disclosures of sensitive personal information;

(h) withdraw consent;

(i) object to or restrict certain processing;

(j) appeal our decision on a privacy request; and

(k) receive equal service and not be discriminated against for exercising a privacy right.

13.1 Submitting a Request

Describe the right you wish to exercise and provide enough information for us to identify the relevant records. If your request concerns information processed for a Cosmick client, identify the client if possible.

13.2 Verification

We may request information reasonably necessary to verify your identity and authority. We will use verification information only for verification and security.

We may deny or limit a request where we cannot verify it, an exception applies, or the request is manifestly unfounded or excessive.

13.3 Authorized Agents

Where permitted by law, you may use an authorized agent. We may require proof of authorization and may verify your identity directly.

13.4 Appeals

If applicable law gives you a right to appeal, reply to our decision or email support@cosmickmedia.com with “Privacy Appeal” in the subject line.

Include the original request and the reason you believe the decision should be reconsidered.

13.5 Timing

We respond within the period required by applicable law. If we need additional time where legally permitted, we will notify you.

14. Additional U.S. State Privacy Disclosures

For residents of states with comprehensive privacy laws, the categories of personal information we may have collected during the preceding twelve (12) months are described in Section 1; the sources are described in Section 2; the purposes are described in Section 3; and the categories of recipients are described in Section 5.

We do not sell personal information for money. As explained in Section 8, certain advertising or analytics disclosures may be considered sale, sharing, or targeted advertising under some state laws.

You may exercise applicable opt-out rights using the methods in Sections 8 and 13.

We do not knowingly sell or share the personal information of individuals under sixteen (16). We do not use or disclose sensitive personal information for the purpose of inferring characteristics except as permitted by law.

We do not offer financial incentives in exchange for personal information unless we provide a separate notice describing the material terms.

15. Children’s Privacy

The Services are intended for adults and are not directed to children under eighteen (18).

We do not knowingly collect personal information from a child under thirteen (13), or from a minor where parental consent is legally required, without the required authorization.

If you believe a child provided personal information to us, contact support@cosmickmedia.com so we can investigate and take appropriate action.

16. International Users and Data Transfers

Cosmick is based in the United States. If you access the Services from another country, your personal information may be processed in the United States and other countries where our providers operate.

Those countries may have privacy laws different from the laws where you live.

Where applicable law requires safeguards for an international transfer, we take steps intended to use an appropriate transfer mechanism.

Individuals in the European Economic Area, United Kingdom, Switzerland, or another jurisdiction with similar rights may contact us to exercise applicable rights or ask about transfer safeguards.

17. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our Services, technology, practices, or legal obligations.

We will post the updated Policy with a revised “Last Updated” date. When required by law, we will provide additional notice or obtain consent before applying a material change.

Changes to this Policy do not retroactively expand the scope of mobile messaging consent.
